H1B visas are issued to foreign individuals in specialty occupations. To qualify for an H1B visa, you will need employer sponsorship. In recent years, the number of visas available for H1B professionals has decreased.

Because of Cap issues (the number of H1B visas allowed by Congress), many qualified immigrants are forced to seek other avenues for entry into the United States to work. H1B visa Cap options and alternatives may include the following:

H1B employer exemptions: Certain occupations and employers are exempt from the Cap limitations placed on H1B visas, including a higher education (or a related or affiliated nonprofit entity) and a nonprofit research organization or governmental research organization.

H1B advanced degree exemption: Each year 20,000 immigrants with advanced degrees from accredited U.S. institutions will also be exempt from the Cap limitations on H1B visas.

Artists, Entertainers and Athletes Visa

Artists, entertainers and athletes can come to the United States to perform under a couple different non-immigrant visas, including an O visa and a P visa.

P visas are issued to artists, entertainers and athletes coming to the U.S. to perform or compete. O visas are for individuals with extraordinary abilities and can include artists, entertainers and athletes.

O visa requirements are more stringent than P visa requirements. Although both are non-immigrant visas, a P visa holder must maintain residence in their home country, while an O visa holder has no residency requirement. Generally, O visas are for longer periods of times.

Professors and Researchers Visas
